The information and services available on or through the fatburn.com site and in any email messages sent to fatburn.com members come from a variety of third party sources (we DO NOT sell or give away your email address to anyone)and are not intended to be a substitute for professional or medical advice and must not be taken to be the rendering of professional advice or the practice of medicine. Your use of the fatburn.com site and information available through it is solely at your own risk.

Fatburn, inc. (the "Company") is not responsible for the accuracy, reliability, effectiveness, or correct use of information and/or services you receive through the fatburn.com Site, or for any health problems you may suffer which may result from training programs, products, or events you learn about through the fatburn.com Site.  Fatburn, inc. assumes no liability for the information and services provided through the fatburn.com  Site or for any diagnosis or treatment made in reliance thereon.

When you become a member of fatburn.com, you agree to indemnify and hold harmless Fatburn, inc. for any loss, liability, claim, damage, and expenses (including reasonable attorneys’ fees) arising from or in connection with your use of the information or services you receive through the fatburn.com  Site.  You expressly agree that use of the site is solely at your own risk.  Neither the Company, nor our officers, directors, employees, agents, affiliates, advertisers, sponsors or others warrant that the use of the Site will be uninterrupted or error free;  nor do they make any warranty as to the results that may be obtained from the use of the site; or as to the accuracy, reliability, or currency of any information, content, service or merchandise provided on or through the site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.  Fatburn.com is not responsible or liable for any damage, including damage caused by viruses, to your computer, computer system, or other property, during or because of access or use of this Web site or any sites linked to this site. fatburn.com and your access to it, are provided on an “As Is” and “As Available” basis and we specifically disclaim warranties of any kind, either expressed or implied.

Terms of Service
The fatburn.com subscription costs vary, depending on the subscription offer that you choose.  Generally, the fee to use fatburn.com is $3.75 per week, with an initial commitment of one month.  After the initial minimum one-month term, your account is automatically renewed and you are responsible for automatic renewal monthly charges until you notify Fatburn, Inc. of cancellation.  Your credit card will automatically be charged every 30 days following the date of your initial order ("Billing Date"). If your credit card is made unavailable to Fatburn.com (declined, cancelled, or otherwise), you are responsible for providing Fatburn, inc. with a new credit card number within 10 days of your Billing Date, or else your membership will be cancelled, and all of your historical data may be permanently erased from our database (although by policy, we not purposefully delete your historical data for a period of 90 days after cancellation or termination). We will make an effort to notify you prior to terminating your membership, although there can be no guarantee that we will be able to do so.  It is your responsibility to check the MEMBERS tab at fatburn.com  to ensure that your account is current.   To cancel, you must contact Fatburn, inc. by using the Contact Us tab to request cancellation. Cancellations are not retroactive. However, because you are billed at the start of each billing period, access to fatburn.com will be granted to until the end of the billing period.

Fatburn, inc. has the right to modify, suspend, or discontinue any portion of the site, materials or services at any time.  We also have the right to terminate your membership without prior notice or consent.  We will refund the pro-rata portion of your paid membership if this occurs.

Disclaimers
fatburn.com is a tool for you to utilize to help you achieve your weight-loss goals.  Its sole purpose is to act as a journal for you to track your daily, weekly and monthly caloric intake and burn. We cannot guarantee weight loss for any individual using any of the products mentioned on this Web site or linked sites. If you want to lose weight and are under 18, pregnant, nursing, have health problems or want to lose more than 30 pounds, please consult a physician before starting any diet program.

Users of fatburn.com should speak with their own doctors about their individual needs before starting any exercise program. This Web site is not intended as a substitute for the medical advice and supervision of your personal physician. Any application of the recommendations set forth in the following pages is at the viewer's discretion and sole risk. If you are over 35 or have been inactive for a few years, see your physician before beginning any exercise program. This is especially important if your family has a history of heart disease, high blood pressure, high cholesterol, diabetes, arthritis, obesity, cigarette smoking, or other health conditions. If you have any doubts whatsoever, consult your physician.

choosing prior to participation in coaching services with Fatburn.com. In 
choosing to participate, I am not relying on the advice of Fatburn.com, or any 
of its its coaches, independent contractors, or agents as to as to my current 
physical ability and health. I hereby release and hold harmless Fatburn.com, its 
employees, coaches, independent contractors and agents from all liability for 
any loss or damage, in any claims or demands on account of injury to the person 
or property or resulting in the death of the undersigned caused by the 
negligence of Fatburn.com, its employees, coaches, independent contractors and 
agents. I hereby assume all responsibilty for any risk of bodily injury, 
property damage or death, and any claims or demands therefore on account of 
injury to the person or property or resulting in the death of the undersigned 
cased by the negligence of Fatburn.com, its employees, coaches, independent 
contractors and agents during or arising from the undertaking of this program of 
general health and fitness. I understand that Fatburn.com, its employees, 
coaches, independent contractors and agents are not physicians but merely 
nutritional and fitness counselors. Therefore any and all advice dispensed will 
be given to my person physician prior to my undertaking of it. The above applies 
to all advice administered by Fatburn.com, its employees, coaches, independent 
contractors and agents either in person, by e-mail, by phone, on the website, or 
any other form of communication.
